4.5 Feedback. Customer may provide feedback to OpenFaaS Ltd about the Products (e.g. technical support input, suggestions, or enhancement requests). 4.6 Transition to Standard Requires Prior Written Approval; Historical Custom Terms. OpenFaaS Standard is a separate commercial offering made available on Supplier's standard commercial, legal, support, ordering, and procurement terms.

Where Customer has licensed OpenFaaS for Enterprises, or where Customer has required, accepted, or benefited from any custom, negotiated, or non-standard legal, commercial, support, security, onboarding, invoicing, procurement, or other business terms or processes in connection with OpenFaaS Standard or OpenFaaS for Enterprises, Customer may not renew, convert, downgrade, migrate, transition to, or obtain OpenFaaS Standard through Supplier's standard checkout, standard invoice flow, or standard-form terms unless Supplier has first approved that transition in writing.
40
+
41
+
For the avoidance of doubt, this Section reflects that OpenFaaS Standard is offered only on Supplier's standard-form legal and commercial basis, whereas Enterprise arrangements may include bespoke legal, support, liability, security, procurement, and commercial terms that cannot be unwound, replaced, or transitioned through self-service purchase, standard-form terms, or by implication.
42
+
43
+
Any such transition requires new legal review, new scoping, and a new written agreement signed by authorised representatives of both parties. Supplier may approve or decline any such request in its discretion and may condition any approved transition on revised pricing, a minimum term, transition fees, professional services fees, and such technical, legal, and commercial conditions as Supplier specifies in the applicable Order Form or migration agreement.
44

45

Supplier is under no obligation to preserve any prior discount, concession, service level, indemnity, liability position, support arrangement, or other non-standard term except as expressly set out in that new written agreement.

63
(b) OpenFaaS Ltd. shall bear no costs, liabilities, or obligations related to the Customer's failure to renew or remit payment for licenses in a timely manner. The Customer acknowledges and agrees that maintaining a valid and active license is 100% their responsibility, and any interruption or cessation of access to the Licensed Software due to non-renewal or non-payment shall not entitle the Customer to any remedies or compensation from OpenFaaS Ltd.

Where Section 4.6 applies, any replacement, migration, transition to OpenFaaS Standard, or continued use requires Supplier's prior written approval and a new written agreement signed by authorised representatives of both parties.
